This three-day conference is the first in a series of planned biannual events on the subject of counter-terrorism legislation and jurisprudence in the European criminal justice area.
The objective of the conference is to evaluate the impact of the fight against terrorism on EU legislation in the field of criminal justice and, in a second step, to analyze the interplay between EU and domestic counter-terrorism laws.
Existing instruments and current initiatives, such as the amendment of the framework decision on combating terrorism to include public provocation to commit terrorist offences, recruitment for terrorism and training for terrorism, will be presented and their added value discussed. The special rules applicable in the criminal proceedings of counter-terrorism cases, from pre-trial to post-trial, will be presented and their effectiveness, appropriateness and impact on the principle of the right to a fair trial discussed.
An important focus will be the case-law of the European Courts in Luxembourg and Strasbourg in counter-terrorism cases. Finally, time will be devoted to consider the results achieved during the conference and to discuss the need for further counter-terrorism legislation in the EU and a forthcoming common counter-terrorism strategy.
